Interactive Viewer - Terms and Condition of Use

The Coal Authority is pleased to provide access to this Interactive Viewer and related web services. Please read the following information regarding their use and the licensing of the information provided herein:

By remaining on this website and using the Coal Authority's Interactive Viewer and web services, you hereby acknowledge and agree to the Terms and Conditions of Use set out below.

The Coal Authority provides information on the Interactive Viewer at two levels of resolution depending on your requirements. Whilst the Coal Authority holds several data sets in addition to those available through the Interactive Viewer, these have not been made available for reasons of data protection.

Planning Theme- Lower Resolution Data

The data available through the Lower Resolution Tab of the Interactive Viewer can be viewed at a scale of 1:25,000 or smaller and may be accessed and used free of charge, subject to the terms and conditions of Open Government Licence.

Coal Mining Theme - Higher Resolution Data

The data available through the Higher Resolution Tab of the Interactive Viewer can be viewed at a scale larger than 1:25,000. This information is provided pursuant to the Environmental Information Regulations 2004 ("EIR"), and subject to the exemptions therein. Open Government Licence terms do not apply to information accessible through the Higher Resolution Tab.

For the avoidance of doubt, EIR does not affect the intellectual property rights of the Coal Authority in the Interactive Viewer, including its copyright and data base right. In particular, the extraction or reproduction of information from the Higher Resolution Tab for a commercial search report (including for a "nothing found" report) will constitute a breach of the Coal Authority' s intellectual property rights and is not permitted without a licence from the Coal Authority.

Depending on your needs, Coal Mining Theme - Higher Resolution data can be provided by the Coal Authority as a specific report or, on request, under licence from us. For property conveyancing purposes, the Coal Authority draws your attention to the CON29M Coal and Brine Mining Search Report recommended by the Law Society of England and Wales, which contains additional property/site-specific information and advice.
